Prior to trial, legal analysis is undertaken to determine appropriate measures to ensure no constitutional violations will be suffered by the client. Legal arguments are filed and presented orally to the trial judge. Typical motions filed include but are not limited to; dismissal of charges, suppression of statements, limitation of testimony, suppression of evidence, introduction of evidence, production of documents, challenges to chains of custody.
Throughout the course of proceedings, many cases eventually are dismissed with no further consequences to the client. If a case is not dismissed and no acceptable plea bargain has been reached, the client is entitled to proceed to trial.
Trial can be to the judge alone(bench trial) or to a jury of between 3 and 12 lay persons.
