Counseling Alternatives
Many criminal offenses involve the use of alcohol and/or drugs. Therapy and counseling may prove to be important for several reasons in your ciminal case, and although it may seem a waste of time and money, it can often mean the difference between incarceration and freedom. Furthermore and more importantly is quality of life.
For someone who truly has a substance abuse problem, counseling and therapy can be extremely beneficial. Whether someone genuinely needs therapy in order to maintain permanent sobriety or whether a person only needs to abstain for a period of time and impress upon the courts their desire and willingness to do so, therapy and counseling are often important elements to a successful defense.
This may mean monitored sobriety entailing random breathalyzers or urinalysis testing, therapy group participation, one on one counseling, weekly DUI classes, Alcoholics Anonymous meetings, or any combination of the preceding.
DOMESTIC VIOLENCE AND ANGER MANAGEMENT CLASSES
When a person is convicted of any offense with a Domestic Violence tag to it, unless sentenced to straight jail or DOC, domestic violence classes are required per statute. The number of classes depends upon prior DV offenses, the severity of the offense and when the offense was committed. The ordinary length of treatment is between 36-72 weeks.
Anger management classes may also be required as a part of a sentence to probation when the inability to control one's anger is at issue. If a person is likely to be convicted of an offense involving violence, it is necessary to establish mitigation. One way to accomplish this goal is with counseling to address the apparent underlying issues. Taking steps to deal with anger management issues are often impressive in the eyes of the court and helpful in plea negotiations with the District Attorney's office.
